Terms of Service

1. Overview

These Terms and Conditions govern the use of the Nritya Chitra website and all photography services offered by Nritya Chitra, owned and operated by Nandagopal Rajagopal (ABN to be inserted), Melbourne, Victoria, Australia. By engaging Nritya Chitra services or using this website, you agree to be bound by these terms.

These terms are governed by the laws of Victoria, Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

2. Booking & Confirmation

All bookings are subject to availability and are confirmed only upon:

  • Written confirmation from Nritya Chitra (email is accepted)
  • Receipt of any applicable deposit where required

Until both conditions are met, no booking is considered confirmed and no date is held.

3. Pricing, Payment & GST

All prices quoted by Nritya Chitra are in Australian Dollars (AUD). Prices are inclusive of GST unless otherwise stated in writing.

Payment Terms

  • For event and concert photography, payment is due within 7 business days of being notified that your selection gallery is ready.
  • For portrait and private sessions, payment terms will be confirmed at the time of booking.
  • Payment methods accepted will be confirmed at the time of booking.

Deposit Policy

  • Where a deposit is required, the amount and conditions will be specified at the time of booking.
  • Deposits are non-refundable unless Nritya Chitra cancels the booking.
  • The deposit amount will be applied toward the total invoice.

Late Payment

  • If payment is not received within the specified timeframe, access to your selection gallery may be revoked.
  • A reactivation fee of AUD $25 may apply to restore access to a lapsed gallery.
  • Nritya Chitra reserves the right to decline future bookings in the event of repeated non-payment.

4. Concert Photography

Group Concerts

  • Photography is conducted from the audience’s perspective, focusing on close-ups of performers where venue conditions permit.
  • Due to seating restrictions, lighting conditions, and the live nature of performances, specific poses or moments cannot be guaranteed.
  • To assist with identification in group performances, please provide the dancer’s name, position in the group, performance number, and a costume photo taken on the day of the concert.
  • Unedited, watermarked preview images will be uploaded to a private cloud folder for your selection.
  • Preview images are for selection purposes only and must not be shared, downloaded, or distributed.
  • You have 7 business days from notification to make your selections and complete payment. Failure to do so may result in access being revoked and images being deleted to free storage for other projects.
  • A minimum order of 3 edited images applies per dancer per concert. Flexibility may be considered where this is not achievable due to shoot conditions.
  • Each dancer is billed individually. Group discounts are not available unless dancers are siblings performing in separate items, in which case a discount may be offered at Nritya Chitra’s discretion.
  • Final edited images will be delivered to a separate folder in the same cloud location once editing is complete.
  • Selection images will be deleted upon delivery of final images.

Individual Concert Photography

  • A session date is confirmed upon written agreement and receipt of any applicable deposit.
  • All terms relating to image selection, delivery, and payment above apply.

5. Portrait & Private Sessions

  • Sessions are by prior appointment only.
  • Please arrive on time and prepared as discussed — outfits, props, and any specific requests should be confirmed in advance.
  • After the session, a selection gallery of unedited, watermarked images will be shared for your review.
  • High-resolution final images will be delivered via a secure cloud link once editing is complete.
  • All images will be edited in Nritya Chitra’s signature style. Requests for additional edits after delivery are subject to availability and may incur additional fees.

6. Event Photography

  • Event bookings are confirmed upon finalisation of event details and receipt of any applicable deposit or retainer.
  • The client is responsible for providing accurate event schedules, venue addresses, and key contact details before the event.
  • Nritya Chitra’s approach prioritises candid, documentary-style coverage. While every effort will be made to cover key moments, specific shots cannot be guaranteed due to the live nature of events.
  • The number of final delivered images will vary based on event duration and activity levels.
  • All delivered images will be colour-corrected and edited in Nritya Chitra’s signature style.

7. Copyright & Intellectual Property

All photographs taken by Nritya Chitra remain the exclusive intellectual property and copyright of Nritya Chitra (Nandagopal Rajagopal) at all times, including after delivery of final images.

Client Usage Rights

  • Upon full payment, clients receive a non-exclusive, non-transferable licence to use delivered images for personal and non-commercial purposes.
  • Commercial or promotional use of images requires a separate written agreement and may be subject to additional licensing fees.
  • Clients are welcome to share final images on personal social media. Please credit @nandagopalr on Instagram or tag Nandagopal Rajagopal on Facebook.

Watermarks

  • All final images will include a Nritya Chitra watermark.
  • Removal, cropping, or alteration of watermarks is strictly prohibited.

Portfolio Use

  • Nritya Chitra may wish to use selected images for portfolio display, website galleries, or promotional purposes.
  • Portfolio or promotional use will only proceed with your explicit written consent, which may be sought separately.
  • You may withdraw consent at any time by contacting nandan@nrityachitra.com.au.

8. Model Release & Consent

By engaging Nritya Chitra services, you acknowledge that photographs may be taken of you or persons in your care. Use of images for any purpose beyond personal use requires a separate signed model release form, which will be provided upon request.

For images of minors, a parent or legal guardian must provide written consent before any images are shared, delivered, or used for any purpose.

9. Cancellation & Rescheduling

  • Cancellations or rescheduling requests must be made in writing as early as possible.
  • Where a deposit has been paid, it is non-refundable in the event of client cancellation.
  • Where Nritya Chitra is unable to fulfil a booking, a full refund of any deposit or payment will be provided.
  • Specific cancellation timelines and conditions will be confirmed at the time of booking.

10. Liability

While every effort is made to deliver high-quality photography services, Nritya Chitra is not liable for circumstances beyond reasonable control, including but not limited to: adverse weather conditions, venue access restrictions, technical equipment failure, power outages, or other unforeseen events.

To the maximum extent permitted by Australian Consumer Law, Nritya Chitra’s total liability for any claim arising from photography services is limited to the total amount paid by the client for those services.

Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited.

11. Additional Products & Services

Additional products including canvas prints, photo books, framed prints, and digital packages are available on request. Pricing and turnaround times will be provided separately.

12. Amendments

Nritya Chitra reserves the right to update these Terms and Conditions at any time. The current version will always be published at nrityachitra.com.au/terms. Continued use of services after any amendments constitutes acceptance of the updated terms.
